We are seeking your feedback on a proposal for changes to Byron Local Environmental Plan (LEP) 2014.
A planning proposal is a document used to amend the Byron LEP, which regulates zoning and development in the Shire.
‘Housekeeping’ amendments are routine updates to ensure planning controls are:
- current
- correct and
- fit for purpose to meet community expectations
This planning proposal includes both policy related and mapping amendments.
Policy Related Amendments
We’re proposing to:
- Fix some incorrect addresses and property descriptions in the heritage schedule and matching maps.
- Add new heritage items to the heritage schedule and maps.
- Make it clear that secondary dwellings (like a granny flat) cannot be strata subdivided.
- Update Clause 4.1B to remove old wording and better match current policies.
- Update Clause 4.1E so semi-detached homes have a suitable minimum lot size, consistent with SEPP (Housing) rules.
- Clarify the wording in Clause 4.2A about when a property has a dwelling entitlement.
- Remove the requirement for a shared driveway for some housing types in rural zones (Clause 4.2D).
- Remove roadside stalls from Schedule 2 - Exempt Development because these are already covered in the State Environmental Planning Policy (Exempt and Complying Development Codes).
- Update the land-use tables so they better match the objectives of each zone and fix small inconsistencies.
Mapping Amendments
We’re proposing to:
- Update the Multiple Occupancy & Community Title Map to remove properties that have since converted to a community title scheme.
- Fix minor mapping errors that occurred during the rezoning of deferred‑matter land from Byron LEP 1988 to the appropriate zones in Byron LEP 2014.
- Adjust minimum lot sizes for some R2 Low Density Residential areas in Byron Bay so they match neighbouring R2 land.
- Rezone part of the road reserve at Dudgeons Lane to E4 General Industrial and update all related maps (height, lot size, floor space ratio).
- Rezone surplus Transport for NSW lots from deferred matter to RU2 Primary Production.
- Rezone certain Tweed Byron Aboriginal Land Council properties in Byron Bay to R3 Medium Density Residential.
